Editorial Policies
1) Focus and Scope / Editorial Line
The Revista Direito em Movimento, published by the School of Judges – State of Rio de Janeiro (EMERJ), is an academic space dedicated to the critical and transdisciplinary reflection on Law in dialogue with other social sciences. Its purpose is to promote the encounter between Law, philosophy, history, sociology, anthropology, and other areas of knowledge, highlighting the necessary interrelation between Law and Justice.
With the motto “another law is possible,” the journal seeks to broaden the horizons of legal culture, valuing human complexity and the multiple contexts that permeate socio-legal conflicts. It is an online collection of scientific articles and essays that foster the exchange of ideas among researchers from national and international institutions, strengthening a plural, critical, and innovative dialogue on the role of Law in contemporary society.

2) Journal History
Over its sixteen years of existence, Revista Direito em Movimento has undergone several transformations that reflect its trajectory of growth, consolidation, and commitment to scientific quality. In recent years, these changes have become even more significant, representing the advances achieved by the publication with the support of the legal and academic community.
In 2018, Direito em Movimento began a restructuring process aimed at improving editorial quality and scientific production, with the implementation of the Open Journal Systems (OJS) platform and the formation of a more diverse Editorial Board composed of researchers from leading Brazilian higher education institutions, as well as universities in Spain, Scotland, Italy, and Germany. This expansion of representation sought to strengthen the journal’s presence in academia and achieve higher levels in the Qualis/CAPES evaluation. During the 2017–2020 quadrennium, the journal reached the Qualis B3 level, a milestone that consolidated its position in the scientific community and reinforced its commitment to continuous improvement.
As of 2024, Direito em Movimento adopted the continuous publication model (CP), publishing articles in a single annual volume with ongoing manuscript evaluation. This change reaffirmed its commitment to the principles of Open Science, including the acceptance and evaluation of manuscripts previously deposited in recognized preprint servers. During the same period, the journal strengthened its adherence to international standards of interoperability and digital preservation, activating the LOCKSS and CLOCKSS systems and implementing the OAI-PMH (Open Archives Initiative – Protocol for Metadata Harvesting) in the OJS platform, enabling the automated collection of metadata by indexers and scientific repositories, expanding its visibility and international integration.
Additionally, the journal consolidated new editorial policies aligned with the principles of Open Science and the IDEIA values (Impact, Diversity, Equity, Inclusion, and Accessibility), reaffirming its commitment to transparency, diversity, and innovation in scientific communication. These guidelines strengthen Direito em Movimento’s role as a dynamic space for the dissemination of legal and interdisciplinary knowledge, promoting the wide circulation and open access of high-quality academic production.
In 2025, Direito em Movimento consolidated important editorial and technological advances by assigning a Digital Object Identifier (DOI) to all published articles, ensuring traceability, authenticity, and digital persistence. In alignment with the global Open Science movement, the journal incorporated into its editorial policies compliance with the FAIR (Findable, Accessible, Interoperable, Reusable) and TRUST (Transparency, Responsibility, User Focus, Sustainability, Technology) principles, guiding its ethical and technical conduct to promote more open, responsible, and inclusive scientific communication.
Starting in 2026, Direito em Movimento will begin a new stage of academic and technical strengthening, guided by strategic goals of internationalization and editorial excellence. Among its main initiatives, the journal plans indexing in major databases and impact indexes, consolidating its visibility and credibility in the national and international scientific community.
As part of this process, published articles will also be made available in HTML and XML formats, expanding accessibility, interoperability, and integration with academic search platforms, in line with standards adopted by high-impact journals. During the same period, the journal will adopt stricter submission criteria, accepting only articles authored by PhDs, doctoral candidates, or master’s students co-authoring with PhDs, reinforcing its commitment to scientific quality, originality, and academic excellence.
Finally, Direito em Movimento maintains its commitment to participating in the training activities promoted by ABEC Brasil, seeking continuous updates on the best editorial and interoperability practices. Thus, the journal reaffirms its purpose of promoting the dissemination of legal and interdisciplinary knowledge with academic rigor, diversity, and transparency, consolidating itself as a reference in the field of scientific communication in Law.
3) Article Processing Charges (APCs)
Revista Direito em Movimento does not charge any submission, evaluation, or article processing fees (Article Processing Charges – APCs), reaffirming its commitment to open and free access to scientific knowledge.
4) Peer Review Process
All manuscripts submitted to Revista Direito em Movimento are received exclusively through the Open Journal Systems (OJS) platform. After submission, manuscripts undergo a preliminary desk review by the executive secretaries, who verify compliance with the journal’s submission and formatting guidelines.
Manuscripts that meet the formal requirements are forwarded for double-blind peer review, conducted by at least two ad hoc reviewers who are experts in the thematic areas of the work.
Upon completion of the evaluation and selection process, authors are notified by email regarding the acceptance, revision request, or rejection of their articles.
The reviewers’ opinions are for internal use only by the editorial team, and the identities of the reviewers involved in each process are not disclosed.

5) Publication Frequency
Since 2024, Revista Direito em Movimento has adopted the continuous publication model (CP), in which approved articles are progressively published in a single annual volume, ensuring greater agility in scientific communication.
On average, the journal publishes ten or more articles per year, depending on the submission flow and editorial schedule.
Until 2023, editions were organized and published biannually, in distinct volumes and issues.
6) Open Access, Open Science, and Interoperability Policy
This journal provides immediate open access to its content, following the principle that making scientific knowledge freely available to the public promotes greater global democratization of knowledge.
Revista Direito em Movimento is committed to the principles and practices of Open Science, ensuring that its content is accessible, interoperable, and reusable in accordance with the FAIR (Findable, Accessible, Interoperable, Reusable) and TRUST (Transparency, Responsibility, User Focus, Sustainability, Technology) principles.
Interoperability is one of the pillars of the journal’s editorial policy, enabling technical integration with national and international platforms, repositories, and indexers. To ensure this system communication, the journal uses the Open Journal Systems (OJS) platform, version 3.3.0.16, which implements the OAI-PMH (Open Archives Initiative – Protocol for Metadata Harvesting).
This protocol allows the automated collection of article metadata by scientific databases and services, enhancing the visibility, dissemination, and digital preservation of the knowledge produced. Metadata are provided in open standards compatible with national and international interoperability systems.
The journal has an active registration with Crossref and assigns a Digital Object Identifier (DOI) to all articles published since 2025, ensuring the traceability, authenticity, and persistence of scientific content.
Regarding digital preservation, the journal adopts the LOCKSS and CLOCKSS systems, ensuring redundancy and long-term security of all published files.
The journal encourages and supports the use of tools that promote the management and sharing of scientific data, reinforcing its commitment to the FAIR ecosystem and research transparency.
In line with the DEIA (Diversity, Equity, Inclusion, and Accessibility) principles, Revista Direito em Movimento has implemented digital accessibility resources through a Libras accessibility plugin in OJS and alternative texts, aiming to promote greater inclusion of all readers and authors. The journal also seeks to progressively follow the General Principles for Creating Accessible Content proposed by PKP (Public Knowledge Project), strengthening its commitment to accessibility and inclusive scientific communication.
The journal actively participates in the initiatives and training activities promoted by ABEC Brasil, staying up to date with editorial best practices and technical standards of interoperability, integrity, and open scientific communication.
Finally, the journal recognizes the international movement toward open peer review and closely monitors its developments. However, it understands that in the field of Law, the immediate adoption of this model presents specific challenges, especially due to the interpretive and sensitive nature of legal analysis. Nevertheless, Revista Direito em Movimento reaffirms its gradual commitment to this process, seeking solutions and practices that balance transparency, ethics, and academic security to advance responsibly toward increasingly open and collaborative science.
7) Gender and Sex Equity in Research Policy
Revista Direito em Movimento reaffirms its commitment to the principles of Diversity, Equity, Inclusion, and Accessibility (DEIA), promoting editorial practices that contribute to the expansion of scientific knowledge, the reduction of structural inequalities, and the appreciation of plural perspectives.
The journal actively seeks to address systemic inequalities and biases, ensuring equitable opportunities for authors, reviewers, and members of the editorial board, as well as fostering an inclusive, accessible, and representative editorial environment.
Editors are guided to:
- Expand diversity in the selection of reviewers and collaborators;
- Encourage the use of inclusive and accessible language in submitted and published texts;
- Promote inclusive citation practices that recognize different perspectives and historically underrepresented groups.
The editorial team remains attentive to the barriers faced by authors, reviewers, and editors belonging to minority groups and acts to:
- Prevent discrepancies in article acceptance related to gender, institutional affiliation, nationality, disability, or social background;
- Mitigate biases in editorial decision-making and peer review processes;
- Implement alternative procedures that promote equity, inclusion, and accessibility;
- Adopt sustainable standards and practices that foster an ethical, diverse, and inclusive editorial culture.
8) Policy on the Use of Artificial Intelligence
Revista Direito em Movimento recognizes the growing role of Artificial Intelligence (AI) in the production and dissemination of scientific knowledge and supports its ethical, responsible, and transparent use. This policy establishes guidelines for authors, reviewers, and editors regarding the use of AI tools in all stages of the editorial process.
The use of AI must not replace human authorship, nor compromise the scientific integrity, originality, or intellectual responsibility of authors.
When submitting a manuscript, authors must explicitly confirm that the content was created by humans and that no AI tool was used to autonomously generate text, images, data, or references.
If AI tools were used for technical assistance, language editing, translation, data analysis, or methodological support, this information must be clearly stated in the “Methods” section of the article, describing which technology was used, for what purpose, and at which stage of the work.
During submission, authors must also include a short note in the “Comments for the Editor” field about the use of AI, for internal record and potential verification.
The use of AI tools is not permitted for preparing peer reviews, manuscript assessments, or editorial decisions.
Reviews must be written entirely by human evaluators, preserving data confidentiality and ensuring impartiality, originality, and ethical integrity in the peer review process.
Uploading unpublished manuscripts to public AI tools constitutes a violation of editorial confidentiality and is strictly prohibited.
Editors and reviewers must base their decisions on critical analysis, academic expertise, and human judgment, and may use technological tools only for administrative purposes — such as similarity checks or formatting verification — provided that unpublished content is not exposed.
The journal may conduct additional ethical reviews whenever there is evidence of misuse of AI tools, data manipulation, automated plagiarism, or lack of transparency in disclosing the tools employed. In such cases, the editorial board may request clarifications or additional documentation from the authors.
Noncompliance with this policy — including omission or misuse of AI tools — may result in manuscript rejection during the evaluation process or, in severe cases, article retraction, in accordance with the best editorial practices established by the Committee on Publication Ethics (COPE).
9) Preprint Submission Policy
Revista Direito em Movimento accepts the submission of manuscripts previously deposited in widely recognized preprint servers, as part of its commitment to the principles of Open Science. This practice contributes to the early dissemination of knowledge, expands access to scientific information, and fosters collaboration among researchers.
At the time of submission, authors must indicate in the “Comments for the Editor” field whether the manuscript has been previously made available as a preprint and provide the name of the server and the permanent link (DOI or URL) to the deposit.
The preprint must be properly cited and referenced within the body of the article, following the journal’s citation standards. This transparency ensures traceability of the manuscript and recognizes the contribution of the preprint deposit to the development of the research.
Authors are encouraged to include supplementary information regarding datasets, methodologies, and additional materials to promote reproducibility and transparency in the scientific process.
Ad hoc reviewers are instructed to consider preprints as a legitimate part of the scientific production cycle, ensuring a fair, ethical, and constructive evaluation.
10) Ethics Policy and Guidelines for Good Publication Practices
Revista Direito em Movimento strictly follows the ethical standards and editorial best practices recommended by the Committee on Publication Ethics (COPE), the Associação Brasileira de Editores Científicos (ABEC Brasil), and international research integrity organizations.
This policy guides the conduct of authors, reviewers, editors, and the editorial team, ensuring that all stages of publication — from submission to dissemination — are based on transparency, integrity, impartiality, and academic responsibility.
Editors’ and Editorial Team’s Responsibilities
Editors are responsible for conducting the editorial process with impartiality, diligence, and respect for the diversity of academic perspectives. They must:
- Base their decisions solely on the scientific relevance, originality, and methodological quality of manuscripts;
- Ensure that the editorial process is conducted without discrimination based on gender, race, origin, sexual orientation, religion, nationality, institutional affiliation, academic position, political beliefs, or personal convictions;
- Guarantee confidentiality of all submitted content until publication;
- Take appropriate actions (correction, retraction, or expression of concern) in proven cases of ethical misconduct, following COPE’s Retraction Guidelines;
- Refrain from participating in the editorial handling of manuscripts where any conflict of interest exists — whether personal, professional, institutional, or financial — and ensure that no unpublished material is used in their own research without the authors’ written consent;
- Use plagiarism detection tools: Revista Direito em Movimento uses the Plagius anti-plagiarism software to verify the originality of submitted manuscripts. The editor is responsible for performing these checks before peer review;
- Periodically update editorial policies to reflect best practices in ethics and scientific integrity.
Authors’ Responsibilities
Authors are primarily responsible for the originality, accuracy, and integrity of the information presented in their manuscripts. They must:
- Submit original and authentic works that present accurate results and well-founded discussions; fraudulent or misleading statements constitute unethical behavior;
- Ensure that the content is original and that all third-party material is properly cited and referenced — plagiarism in any form is unacceptable;
- Avoid redundant publication — submitting the same article to more than one journal without prior authorization from editors is prohibited;
- Properly acknowledge the contributions of others through appropriate citations; private information (such as personal communications or project reviews) must not be used without express consent;
- Limit authorship to those who significantly contributed to the conception, execution, or interpretation of the research, ensuring that all co-authors have reviewed and approved the final version;
- Declare any financial or institutional conflicts of interest that could influence the content;
- Notify the editor promptly if a significant error is identified in a published article and cooperate to correct or retract it if necessary;
- Ensure ethical research standards — studies involving human participants or sensitive data must include approval from an ethics committee and comply with applicable national and international regulations.
Reviewers’ Responsibilities
Ad hoc reviewers play a key role in ensuring the quality and credibility of the journal. They must conduct the review process ethically, impartially, and confidentially. Reviewers must:
- Contribute to editorial decision-making and help authors improve their work;
- Inform the editor if they feel unqualified to review a manuscript or unable to meet the deadline;
- Treat manuscripts as confidential documents that must not be shared, discussed, or used for personal purposes;
- Provide objective, clear, and well-founded reviews, avoiding personal or offensive remarks;
- Identify relevant uncited works and notify the editor of possible overlaps, plagiarism, or redundant publication;
- Declare potential conflicts of interest and decline reviews that could compromise impartiality;
- Avoid the use of AI tools to produce reviews — evaluations must be conducted entirely by human judgment;
- Maintain confidentiality of all information obtained during the review and never use it for personal or third-party advantage.
Revista Direito em Movimento will periodically review this policy to ensure ongoing compliance with international standards of ethics, integrity, and editorial best practices.
11) Copyright and Licensing
The copyright of articles published in Revista Direito em Movimento remains with the authors, who grant the journal the right of first publication. This policy ensures the preservation of authorship and public recognition of individual scientific contributions.
All published content is licensed under the Creative Commons Attribution 4.0 International (CC BY 4.0) License. This license allows others to copy, distribute, adapt, transform, and build upon the published material, including for commercial purposes, provided that proper credit is given to the original author and Revista Direito em Movimento.
Authors retain the right to share and archive their published versions in institutional or personal repositories or on preprint platforms, provided that the DOI and full article citation are included.
Revista Direito em Movimento remains fully free of charge, with no submission, review, or processing fees (Article Processing Charges – APCs). This policy aligns with the Diamond Open Access model, ensuring free access, use, and reuse of all published scientific content.
Partial or full reproduction of articles must always respect the terms of the Creative Commons license and clearly cite the original source of publication.
12) Copyright Statement
Authors publishing in this journal agree to the following terms:
- Authors retain copyright and grant the journal the right of first publication, with the work simultaneously licensed under a Creative Commons Attribution 4.0 International License, allowing sharing with acknowledgment of authorship and initial publication in this journal.
- Authors are allowed to enter into separate, additional contracts for non-exclusive distribution of the version of the work published in this journal (e.g., to deposit in institutional repositories or publish as a book chapter), with acknowledgment of its initial publication in this journal.
- Authors are encouraged to post and distribute their work online (e.g., in institutional repositories or on personal websites) at any stage prior to or during the submission process, as this can lead to productive exchanges and increase citation and impact (see The Open Access Effect).
13) Privacy Statement
Revista Direito em Movimento ensures that names, email addresses, and any personal information provided by users during the submission, review, or publication process will be used exclusively for the journal’s editorial and administrative purposes.
This data will not be shared, disclosed, or used for other purposes, nor made available to third parties, except when required by law.
The journal adopts security, confidentiality, and integrity measures consistent with Brazil’s General Data Protection Law (Law No. 13.709/2018), ensuring that data processing occurs ethically, transparently, and within the editorial scope.
By submitting a manuscript or registering in the Open Journal Systems (OJS) platform, users agree to this privacy policy and authorize the use of their information exclusively for scientific communication and editorial management purposes within the publication’s scope.
14) Archiving
- All issues are stored and available in the TJ-EMERJ Library.
- The LOCKSS system is authorized to store and distribute the journal’s content through the LOCKSS Publisher Manifest.
- CLOCKSS is activated to store and distribute the journal’s content across participating libraries through an Editor Page Manifest.
- Metadata interoperability is ensured through the OAI-PMH protocol implemented in OJS, allowing automatic harvesting by repositories and interoperable digital preservation systems.
15) Position on Predatory Journals
Revista Direito em Movimento firmly reiterates its commitment to academic research integrity and strongly condemns the practices of predatory journals. Such publications, which exploit the scientific publishing system for financial gain without proper ethical or academic standards, represent a threat to the credibility and quality of scientific knowledge.
